Last Updated: 18 December 2025

1. INTRODUCTION

Welcome to Mark Intelligence (hereinafter referred to as "the Platform"). By accessing or using our web-based AI conversational assistant (collectively, "the Service"), you agree to be bound by these Terms and Conditions ("Terms").

Important Notice: The Service is currently in a Public Beta phase. This means the Service is still under active development, may contain bugs, and may experience periods of downtime.

If you do not agree to these Terms, you must strictly adhere to the instruction to cease use of the Service immediately. These Terms constitute a legally binding agreement between you ("the User") and Mark Choi ("the Provider").

2. LICENCE TO USE

Subject to your compliance with these Terms, the Provider grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Service strictly for personal, non-commercial, and evaluation purposes.

You acknowledge that as a Public Beta user:

  • Features may change, be added, or be removed without notice.

  • The Provider is under no obligation to provide technical support or guarantee uptime.

3. ACCEPTABLE USE POLICY

To ensure the integrity of the Service and compliance with applicable regulations, strict adherence to this Acceptable Use Policy is required. You agree NOT to:

  • 3.1 Illegal Activities: Use the Service for any purpose that violates the laws of the Macao Special Administrative Region (Macao SAR), Singapore (where our servers are located), or any international laws relevant to your location.

  • 3.2 AI Misuse & Prompt Injection: Attempt to "jailbreak," manipulate, or trick the AI models (Gemini/DeepSeek) into generating content that is illegal, harmful, sexually explicit, hateful, discriminatory, or promotes violence.

  • 3.3 System Abuse: Engage in any activity that interferes with or disrupts the integrity or performance of the Service, including but not limited to denial-of-service (DoS) attacks, high-volume automated querying (scraping), or bypassing usage limits.

  • 3.4 Reverse Engineering: Attempt to decompile, reverse engineer, or discover the source code, underlying logic, or proprietary prompts of the AI Service.

  • 3.5 False Representation: represent the AI-generated output as human-generated work without appropriate disclosure.

4. COMPLIANCE WITH MACAO AND SINGAPORE LAWS

  • 4.1 Cybersecurity: You agree to comply with the Cybersecurity Law (Law No. 13/2019) of Macao. Any attempt to compromise the critical infrastructure of this Platform will be reported to the relevant authorities, including the Judiciary Police (PJ).

  • 4.2 Singapore Jurisdiction: You acknowledge that our underlying infrastructure (provided by Tencent Cloud) is physically located in Singapore. You agree not to use the Service in contravention of Singapore’s Computer Misuse Act or other applicable Singaporean regulations regarding digital conduct.

  • 4.3 Data Protection: In accordance with the Personal Data Protection Act (Law No. 8/2005) of Macao, you are advised not to input real, sensitive, or personally identifiable information (PII) into the chat interface.

5. INTELLECTUAL PROPERTY

  • 5.1 Ownership: All intellectual property rights in the Platform and the Service interface are owned by the Provider.

  • 5.2 AI Models: The underlying AI technologies are provided by Google LLC (Gemini) and DeepSeek.

  • 5.3 User Content: You retain ownership of the queries you input. However, you grant the Provider a worldwide, non-exclusive licence to process your inputs solely for the purpose of generating responses and debugging the Service.

6. DISCLAIMER OF WARRANTIES (PUBLIC BETA)

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind.

  • 6.1 Beta Disclaimer: The Provider does not warrant that the Service will be uninterrupted, secure, or error-free. Data loss may occur during the Beta phase.

  • 6.2 AI Hallucinations: You acknowledge that Artificial Intelligence may occasionally produce incorrect, misleading, or biased information ("hallucinations"). You should always verify important information independently.

  • 6.3 No Professional Advice: The Service is for informational purposes only. It does NOT constitute professional financial, legal, medical, or engineering advice.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;

  • Any content generated by the AI models;

  • Service interruptions caused by our infrastructure providers (Tencent Cloud/Cloudflare).

8. TERMINATION

The Provider reserves the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

9. GOVERNING LAW AND JURISDICTION

  • 9.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Macao Special Administrative Region.

  • 9.2 Jurisdiction: You irrevocably submit to the exclusive jurisdiction of the courts of Macao SAR to resolve any disputes arising out of or in connection with these Terms.

  • 9.3 Infrastructure Location: Notwithstanding the above, you acknowledge that legal disputes related specifically to physical server data may potentially involve the jurisdiction of Singapore.
