By using the services provided by Private Connect, a service provided by Mark Intelligence ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must strictly refrain from using our service.
We provide Virtual Private Network (VPN) services designed to enhance your online privacy and security. Our server infrastructure is hosted on Amazon Web Services (AWS) and is physically located in Singapore. Whilst we strive for maximum uptime and high availability, we do not guarantee uninterrupted service, and connections may occasionally be subject to technical disruptions or necessary maintenance.
To maintain the integrity of our network and ensure fair access for all users, your account is subject to strict bandwidth and device limitations. We actively enforce these limits, and violations will result in service suspension.
3.1. Bandwidth Limits and Immediate Suspension
Free Allowance: Your account is allocated a specific, fixed amount of free bandwidth per calendar month.
Immediate Suspension: Once your allocated free bandwidth is fully depleted, your VPN service will be immediately suspended.
No Top-ups: We strictly do not offer the facility to purchase additional bandwidth or 'top-up' your allowance mid-month.
Reinstatement: Your access remains blocked for the remainder of the month and will only be automatically restored on the first day of the following calendar month.
3.2. Device Limits and the Two-Strike Rule
Concurrent Connections: Your account is restricted to a maximum number of simultaneously connected devices (as specified in your account details).
Strike One (First Offence): Connecting more devices than permitted will result in a formal warning recorded on your account.
Strike Two (Second Offence): A second violation of the concurrent device limit will trigger an immediate suspension of your account.
Reinstatement: As with bandwidth depletion, your service will be entirely disabled until the first day of the following calendar month, at which point it will be reinstated.
You agree to use our VPN service for lawful purposes only. You must not use our service to:
Transmit any material that is illegal, threatening, abusive, or defamatory.
Infringe upon the intellectual property rights of others.
Engage in any form of hacking, port scanning, or distributing malware.
Attempt to bypass our bandwidth monitoring, device counting, or any other system limitations.
Penalty for Unacceptable Use: Any violation of this Acceptable Use Policy will result in the immediate and permanent termination of your account. We reserve the right to enact this permanent ban without prior warning or notice.
Your privacy is paramount to us. We operate a strict minimal-data policy. To enforce the usage limits outlined in Section 3 and to maintain our AWS infrastructure, we only monitor and collect three specific data points: your bandwidth usage (in GB), your Internet Service Provider (ISP), and your concurrent device count. For full details on our strict no-logs policy regarding your browsing activity, please refer to our Privacy Policy.
To the fullest extent permitted by law, Private Connect shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Singapore.
We reserve the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the service following the posting of any changes constitutes your acceptance of those changes.
